With one nut missing the plate will leak rather poorly, but probably 
livable (carry extra oil in the car).  If the stud falls out then you 
have a hole that will empty the case in a couple of minutes, so that 
is not going to work.

This problem seems to occur as a result of several possible causes:

1) Dirt gets in the threads of the cap nuts and this causes the nuts 
to bind up and turn in the case, eventually wearing out the threads 
there.

2) Use of cheap aftermarket cap nuts which are not tapped as deeply 
as they should be.  This causes them to bind up too soon and we then 
force the stud to turn in the case....  I use an M6 x 1 bottoming tap 
to clean these up and they work lots better.

3) Not using the small copper(?) washers under the cap nuts.  This 
forces the studs to enter the cap nuts farther than intended and they 
may bind up and turn in the case....

4) Over torquing the cap nuts.  They take very little torque.  If you 
tighten them too much the sump plate will get deformed around each 
bolt hole and then you will have to tighten even harder...and so on.  
If your sump plate is deformed, hammer or press it back or buy 
another one.  DON'T try to make it seal by tightening it even more.

I have two repairs for this.  If I am rebuilding an engine I install 
hex head bolts from the inside of the case so these will never come 
loose.

If the engine is together, I have a jig that pilots the tap drill and 
the helicoil tap so that the stud ends up parallel to the others.  I 
suspect that if you try to do this by hand, you are very likely to 
end up with things VERY screwed up.
