To be able to check the ATF level you must get it to a predictable level. It is true that it will be higher with the engine off, but I suppose it is not predictable how much higher under all circumstances, otherwise the books would specify checking the level that way, as it is much simpler than checking it with the engine running and the tranny hot (not warm, but HOT, like after a ten mile drive, according to something I read recently).
