Man, this type of activity really burns me up! :( First, it sounds like the BAR is on the "mechanics" side. My *advice*: Don't listen to 'em! Second, I think you should see a lawyer and follow their advice over mine. My thought process is such: Go to two independent VW repair shops and tell them your problem (best not to mention the offending shop unless you think doing so would be okay) and have them give you a written diagnosis (using the shop's letterhead or work sheet) of what they would've done, and charged (estimates), for the initial repair and then the secondary repair of your vehicle. Then go to a *good* tranny shop and get a written estimate on what they would charge for a rebuild (plus and guarantee/warranty). Look in the VW magazines and call a couple of the tranny builders who do Type IIIs and find out the same info. What you're doing is trying to prove that the "mechanic" really doesn't know what he's doing as you will find by the fact he's overcharging you and nothing is working. Basically he is preying on your ignorance, taking advantage of you, and this is a dishonest practice, punishable by law in some states. I don't know of many judges who tolerate such actions anyway (hope you get a female judge ;) . Once you are a "stereotypical girl" the lawyer may very well play on this and it will work to your advantage. If you have your car taken to a final shop to have it fixed definitely be sure to have that paperwork with you and if the work is already done have the shop write down what was wrong and how it may have become so (was the part worn thru normal use or improperly installed) along with the final cost. The reason I think you should see a lawyer is I have a funny feeling about the suing/repayment process. You stopped payment on a check because of poor service -- it's not your fault that he was already paid by the checking service, it should now be theirs. Had the "mechanic" not used the service he would be suing. Curious as to why the service no longer has him... I could be wrong, I don't know CA law, I am not a lawyer and I don't play one on TV. But talking to a lawyer won't kill you and definitely won't hurt!
