While it's possible that there is something going on here which is the fault of 
the builder, nothing I've heard so far leads me to believe that. I guess he 
could be blamed if he KNEW that this was supposed to go in a type 3 and he 
installed the pump/filter anyway.

In my opinion, this is YOUR fault, not the builders. You swapped a part without 
understanding how it worked or what the consequences might be. If the engine 
has been damaged because of this, I don't see how you can blame the builder. I 
know I would be furious and insulted if someone did this to me.

Just my opinion, but I think you have only 2 honest options:

1) Replace the pump with a correct stock pump and see if it runs right now, and 
take your lumps if it doesn't.

2) Contact your builder and explain what you did and that you can't use the 
pump/filter combo in a type 3 engine. Ask him how much he would charge to take 
the engine back and go thru it to see if anything was damaged and to change it 
to something that is compatible with your type 3 application.

Avoid the 30mm pumps. It is not always true that bigger is better. A 25 or 26mm 
pump is plenty big, and you will just have more trouble if you try to find room 
in there for the excessively long pump.
