<x-charset iso-8859-1>Depends on your state. Your damage claim if the other driver is totally at fault, is not related to your own insurance as you wouldnt even be using it if you had it. Here in NY, its not really possible to drive without insurance, or atleast not have legal plates and registration without insurance. Youll get a nice ticket for it in NY but Im not sure how much $$ it would amount to.
